Terms and Conditions

1. Scope

These Terms and Conditions (T&Cs) apply to all deliveries from saltwaterdesigns.de (hereinafter referred to as saltwaterdesigns) to consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither related to their commercial nor their self-employed professional activity.

2. Contracting Party

The purchase contract is concluded with:

3. Conclusion of Contract

3.1. The presentation of products in the online shop does not constitute a legally binding offer, but merely an invitation to place an order.

3.2. By clicking the [Buy / Order with payment] button, you place a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending an order confirmation via email immediately after receiving your order.

4. Right of Withdrawal

4.1. If you are a consumer (i.e., a natural person who places an order for purposes not related to your commercial or self-employed professional activity), you are entitled to a right of withdrawal in accordance with the statutory provisions.

4.2. If you exercise your right of withdrawal, you bear the regular costs of returning the goods.

4.3. Further provisions on the right of withdrawal are set out in the following Withdrawal Policy.

Withdrawal Policy

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, takes possession of the goods.

To exercise your right of withdrawal, you must inform us:

You may use the attached model withdrawal form, but it is not mandatory. You can also fill out and submit the model withdrawal form or another clear declaration electronically via our website https://www.saltwaterdesigns.de/kontakt/. If you do so, we will immediately (e.g., by email) send you confirmation of receipt of your withdrawal.

To meet the withdrawal deadline, it is sufficient that you send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except for the additional costs arising from your choice of a delivery method other than the cheapest standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we are informed of your withdrawal. We will use the same means of payment that you used for the original transaction unless expressly agreed otherwise with you; in no case will you be charged fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have provided proof of return, whichever is earlier.

You must return or hand over the goods immediately, and in any case no later than fourteen days from the day you notify us of the withdrawal of this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods resulting from handling them in a way that was not necessary to establish the nature, characteristics, and functioning of the goods.

5. Prices and Shipping Costs

5.1. The prices stated on the product pages include the statutory value-added tax and other price components.

5.2. In addition to the prices, we charge individual shipping costs per order within Germany. The shipping costs will be clearly communicated to you on the product pages, in the shopping cart, and on the order page.

6. Delivery

6.1. Delivery is only made within Germany and the EU.

6.2. Delivery time is generally up to 3 days. Deviating delivery times are indicated on the respective product page and during the checkout process.

7. Payment

Payment can be made using Visa, Mastercard, PayPal, and other payment providers.

8. Retention of Title

The goods remain our property until full payment has been made.

9. Warranty for Material Defects

saltwaterdesigns is liable for material defects in accordance with the applicable statutory provisions, particularly §§ 434 ff. German Civil Code (BGB).

10. Dispute Resolution

The EU Commission has established an online platform for the settlement of disputes. This platform serves as a point of contact for out-of-court settlement of disputes relating to contractual obligations arising from online purchase contracts. Further information is available at http://ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
